VAT Voluntary Disclosure in Dubai & the UAE

Found an error in a return already filed? The first decision is not how to complete a form—it is which correction route the law requires.

SAIF reviews the affected tax periods, reconstructs the difference, prepares the evidence and supports a timely, authorised FTA submission where VAT211 is the right route.

A defensible correction starts with the original filing, transaction evidence and a period-by-period calculation.

The short answer

Do you need to file VAT211?

If a filed UAE VAT return understated payable tax by more than AED 10,000, the current Tax Procedures Executive Regulation requires a voluntary disclosure within 20 business days of becoming aware. An understatement of AED 10,000 or less can generally be corrected in an eligible return; if no such return is available, the regulation requires a disclosure within 20 business days.

Errors in refund applications, tax assessments and fields with no tax difference have different rules. Read Article 10 of the Executive Regulation before relying on a simplified threshold. For a real case, document the discovery date and have the full return and evidence reviewed promptly.

Choose the correction—not a shortcut

Four routes that businesses often confuse.

These are starting points under the current Tax Procedures Law and Executive Regulation. The original tax period, tax difference, transaction type and FTA instructions can change the answer.

01

Underpaid tax exceeds AED 10,000

A voluntary disclosure is required within 20 business days of becoming aware of the error.

Calculate the tax difference for the affected return or assessment; document when and how the error was discovered.

02

Underpaid tax is AED 10,000 or less

Generally correct it in the earlier eligible return specified by the Executive Regulation.

If there is no return through which it can be corrected, a voluntary disclosure is due within 20 business days.

03

Refund application overstated the entitlement

A voluntary disclosure is required within 20 business days of awareness.

If the cause is an incorrect return or tax assessment, the route is assessed under the return-error rules.

04

The return has an error but no difference in due tax

Check whether the FTA requires a voluntary disclosure for that kind of error, or permits correction via a later return.

The amended Tax Procedures Law does not treat every zero-tax-impact error identically.

If a return is still editable before its filing due date, check the current EmaraTax correction option rather than treating every draft or recently submitted return as a late VAT211 case. FTA FAQ on editing before the due date →

What usually triggers a review?

Identify the cause, then the full reach of the error.

One incorrect tax code may affect several VAT periods. A missing invoice may affect both the return and the accounting ledger. We trace the originating transaction and test whether the same treatment was repeated before calculating a correction.

Output taxUnrecorded sales, incorrect rate, credit notes or supplies in the wrong period.
Input taxOver-claimed purchases, missing tax invoices, restricted costs or apportionment errors.
Cross-borderReverse-charge entries, imports, exports or designated-zone treatment without sufficient evidence.
ReportingWrong emirate allocation, return boxes or a refund request inconsistent with the filed return.

How SAIF approaches the work

From discovery to a documented correction.

Our scope can be a focused VAT211 assignment or a broader VAT health check where the error may recur across the accounting system.

  1. 01

    Locate

Identify the original return, period, transaction, date of discovery and any FTA notice. Preserve the version already submitted.

  2. 02

    Recalculate

Rebuild the affected VAT boxes and the correct tax position from invoices, ledgers and supporting documents.

  3. 03

    Choose

Apply the current law to decide between return correction, VAT211 or another appropriate response.

  4. 04

    Submit

Prepare the explanation and evidence, agree the amount and authorised access, then submit through EmaraTax where required.

  5. 05

    Resolve

Track the FTA acknowledgement, tax and penalty balance, questions, payment and the control change that prevents recurrence.

Build an evidence trail

What should be ready before submitting VAT211?

Begin with the original filed version, not an overwritten spreadsheet. The FTA’s voluntary-disclosure user guide describes the VAT211 process and supporting documents, but the necessary evidence depends on the actual error.

Prepare a reconciliation from the filed amount to the proposed corrected amount for each tax period, with source documents and a short explanation that a reviewer can follow. Retain both the submitted disclosure and any later FTA correspondence.

2026 penalty framework

Do not budget from an old penalty table.

Cabinet Decision No. 129 of 2025 took effect on 14 April 2026. In the amended schedule, a voluntary disclosure for the specified return, assessment or refund errors can carry a 1% monthly penalty on the tax difference for each month or part of a month. Failure to disclose before an FTA tax-audit notification can add a 15% fixed component, with the monthly component also applying.

The precise calculation depends on dates, the type of error, when disclosure is filed and whether an audit notice has been issued. Tax payment, an incorrect-return penalty or other consequences may also need separate consideration. No adviser can promise that filing VAT211 removes penalties.

Practical VAT211 questions

Questions about correcting VAT returns.

General guidance for UAE VAT-registered businesses; your return, dates and notices determine the actual route.

01What is a VAT voluntary disclosure in the UAE?

It is a formal correction submitted to the Federal Tax Authority for a previously filed return, tax assessment or refund application when the applicable law requires or permits it. For VAT, the portal process is commonly called Form VAT211.

02When is VAT211 required for an incorrect VAT return?

If the mistake understated payable tax by more than AED 10,000, the Executive Regulation requires a voluntary disclosure within 20 business days of becoming aware. Smaller errors and non-monetary errors need their own route assessment; the amount alone does not decide every case.

03Can I put an old VAT error into the next return?

Sometimes, but not automatically. The Executive Regulation provides a return-correction route for an understatement of AED 10,000 or less where an eligible return is available. Larger understatements require voluntary disclosure. Check the period, type of error and current FTA instructions first.

04What if the error is exactly AED 10,000?

The regulation distinguishes an understatement of more than AED 10,000 from one equal to AED 10,000 or less. The latter follows the return-correction route if an eligible return exists; otherwise the regulation requires a voluntary disclosure within 20 business days.

05Does a VAT return error with no tax difference need VAT211?

Not in every case. The amended Tax Procedures Law says an error with no difference in due tax is corrected through voluntary disclosure in cases specified by the FTA, or through a tax return in other cases. Identify the reporting field and current FTA treatment before deciding.

06What if a VAT refund application was too high?

An overstatement of the refund entitlement may require voluntary disclosure within 20 business days of awareness. Where the underlying cause is an incorrect return or assessment, the Executive Regulation points to the return-error rules. Do not simply submit another refund application to conceal the earlier error.

07Can a business disclose an error that caused it to pay too much VAT?

The Tax Procedures Law permits a voluntary disclosure where an incorrect return or assessment made payable tax higher than it should have been. Whether that is the correct practical route, and any refund time limit, should be reviewed against the facts and current FTA process.

08What is the deadline after discovering an error?

For an understatement above AED 10,000, and for certain refund overstatements, the Executive Regulation specifies 20 business days from awareness. Record the discovery date immediately; other correction routes have different timing and the original filing period still matters.

09What are the VAT voluntary disclosure penalties in 2026?

The amended penalty schedule effective 14 April 2026 includes a monthly 1% penalty on the tax difference for certain voluntary disclosures. If the error is not disclosed before an FTA tax-audit notification, a 15% fixed component can also apply. The calculation depends on the violation, dates, tax difference and procedural stage; it is not a universal price list.

10Can I file VAT211 after receiving an FTA tax audit notice?

The correction options and penalties change once an audit notice has been received. Preserve the notice, identify its scope and deadlines, and get case-specific advice promptly. Do not assume that an ordinary pre-notice calculation or process still applies.

11What documents should I prepare for VAT211?

Start with the submitted return or assessment, transaction-level sales and purchase data, tax invoices and credit notes, ledger reconciliation, error calculation by period, discovery record, FTA correspondence and a concise explanation of the corrected treatment. The FTA may request additional evidence.

12Can SAIF prepare and submit my VAT voluntary disclosure?

SAIF can review the facts, quantify the affected periods, recommend the appropriate correction route and assist with Form VAT211 and FTA follow-up under an agreed scope and proper authorisation. The taxpayer remains responsible for accurate information, and the FTA decides the outcome.
